December 2021: Successful Claim Petition in Workers’ Compensation Claim

The Law Offices of Richard A Jaffe, LLC successfully litigated a Claim Petition for a union carpenter who was injured in Delaware working for a Philadelphia-based company. We were able to prove he sustained a work-related injury to his neck, shoulder, low back and cubital tunnel on August 1, 2019, such that he is entitled to approximately $150,000 in back due benefits and ongoing benefits at the rate of $1049 per week.

December 2021: Fully Favorable Decision in Social Security Disability Claim

The Law Offices of Richard A Jaffe, LLC secured a fully favorable decision by an Administrative Law Judge (ALJ) for our 34-year-old client suffering from several rare conditions, including TRAPS, Cushing’s Syndrome, and Stevens-Johnson Syndrome. Although our client is severely disabled, the Social Security Administration (SSA) listings do not address any of these rare conditions, but we were able to prevail on behalf of our client nonetheless.

October 2021: Successful Litigation in Workers’ Compensation Claim

The Law Offices of Richard A Jaffe, LLC successfully litigated a Claim Petition on behalf of our client who sustained an injury to her left shoulder in December 2019. Due to economic pressure, she continued to work through the pandemic, and as her employer refused to provide appropriate accommodations, her left shoulder injury resulted in a frozen shoulder and SLAP tear. The workers’ compensation judge awarded benefits dating back to August 2020 when she could no longer work (over $35,000) and ongoing benefits and medical treatment for her left shoulder.

October 2021: Wins Fully Favorable Decision in Social Security Disability Claim

September 2021: Settles Workers’ Compensation Claim for $258,700

Our 57-year-old client, injured in 2017, underwent an Impairment Rating Evaluation that resulted in a 12% Impairment, despite his very significant low back injury. We were able to secure a lump sum settlement in the amount of $258,700 which was approved by a Workers’ Compensation Judge.

July 2021: Wins Appeal to the Supreme Court of Pennsylvania for $101,000 Award

The PA State Supreme Court affirmed a Commonwealth Court decision involving the Remand Order for Average Weekly Wage calculations, resulting in a Workers’ Compensation Judge awarding $101,000 in back due workers’ compensation along with 9 years of interest for our client. In addition, his weekly benefits will be increased by $130 going forward.

July 2021: Settles Workers’ Compensation Claim for $137,500

After defeating three separate Petitions for Termination and expanding the description of injury to include CRPS in her knee, we were able to settle our client’s workers’ compensation case for $137,500. The settlement will also allow her to accept a Disability Retirement Pension from the Commonwealth of Pennsylvania.

April 2021: Settles Workers' Compensation Claim for $130,000

Secured a $130,000 settlement for a non-English speaking client who sustained a below-the-knee amputation in 2003. Due to the client’s low earnings, this amounts to almost 11 years of future worker’s compensation and specific loss benefits. In addition, we were able to expand the description of injury in 2009 to include neuropathic stump pain, phantom limb pain, and lumbar radiculopathy. As a result of the settlement, the client will be able to continue to receive ongoing medical care for the rest of his life.

February 2021: Secured Social Security Disability / SSI Benefits for a Mentally Disabled Man

Successfully secured concurrent Social Security Disability / SSI Benefits for a 28-year-old male with severe mental disabilities. The ALJ agreed with our arguments and found that our client met one of the stringent mental disability listings, awarding concurrent benefits back to May of 2018.

February 2021: Settles Workers’ Compensation Claim for a Combined $697,923

After seven years of expanding our client's description of injury due to neck surgery, defeating a Petition for Suspension/Modification due to a failure to issue a Notice of Ability to Return to Work and now defending against a Petition for Termination/Modification relating to the original left shoulder injury, we have now resolved her claim for a lump sum in the amount of $271,923 for future wage loss and $426,000 for future medical treatment.

December 2020: Secures Workers’ Comp Wage Loss Benefits for $125,000

The Law Offices of Richard A Jaffe, LLC was able to resolve our client’s entitlement to future wage loss benefits for $125,000 (5 years of workers’ compensation benefits). After sustaining an injury to his left foot in February 2019, our client developed complex regional pain syndrome (CRPS). As the workers’ compensation carrier will not voluntarily accept said injury, we are continuing to litigate whether or not he sustained CRPS as a result of said injury so that he can continue to receive the necessary pain management treatment he so justly deserves.

November 2020: Wins Appeal before the Workers’ Compensation Appeal Board

The Law Offices of Richard A. Jaffe, LLC successfully overturned a WCJ decision granting a Petition for Suspension against our client who was injured by an aggressive and combative MH/MR resident. Even though the IME doctor opined our client could not return to work if required to restrain such residents, the employer offered her old job with just a 10lb lifting restriction. The WCAB agreed with our argument that the employer's job offer did not include the restrictions against restraining residents given that our hearsay objections were sustained. In addition, the WCAB agreed that the judge mistakenly agreed with the workers' compensation carrier's average weekly wage calculations and remanded this case back for calculations consistent with our arguments.

November 2020: Settles Workers’ Compensation Claim for $108,763

The Law Offices of Richard A Jaffe, LLC was able to secure approval of a settlement in the amount of $108,763 (5 years of future workers’ compensation benefits) for a CNA who injured her right shoulder and was released by her orthopedic surgeon. As a result of our efforts, she was able to secure the medical treatment she needed before settling her case.

September 2020: Settles Workers’ Compensation Claim for $85,000 in 25-Year Eye Injury Case

The Law Offices of Richard A Jaffe, LLC secured a lump sum settlement in the amount of $85,000 for an Italian-speaking construction worker injured in 1991. During the almost 25 years we represented him, we were able to expand the description of injury to include cataracts, glaucoma, and major depressive disorder, as well as defeat two Petitions for Termination and Petitions for Suspension based on a job offer. In addition to the lump sum, which is equal to 5 years of future workers’ compensation, we were able to secure ongoing medical treatment for his work-related left eye injuries.

September 2020: Settles Workers’ Compensation Claim for $198,500

The Law Offices of Richard A Jaffe, LLC secured a lump sum settlement in the amount of $198,500 for a truck driver who lives in Texas who was injured in Nashville, Tenn. in 2012. During the seven years we represented him, we were able to secure payment of a cervical fusion, defeat a Petition for Termination and defend against Petitions for Modification based on an Impairment Rating Evaluation and Labor Market Survey. In addition to the lump sum, we were able to secure on-going medical treatment for his work-related neck and shoulder injuries.

November 2017: Settles Workers' Compensation Claim for $437,500

Claimant sustained a work-related injury on April 20, 2012 which was initially recognized as a left shoulder and lumbar sprain. He retained the services of the Law Offices of Richard A. Jaffe, LLC, and Richard was able to expand the description of injury to include herniated discs in the injured worker's lumbar spine and cervical spine, which allowed him to undergo 2 surgeries for his lower back and 2 surgeries for his neck. Thereafter, Richard assisted the Injured worker in securing appropriate medical treatment with a Board-Certified Pain Management Specialist. While litigating these issues, Richard was also able to secure Social Security Disability benefits and Medicare benefits for the claimant. After the claimant underwent an Impairment Rating Evaluation, Richard filed a Petition to Review said IRE and it was set aside by the Worker's Compensation Judge, effectively reinstating the injured worker's entitlement to Temporary Total Disability benefits.

Once claimant's treating surgeon advised that there were no further surgical options available, Richard entered into negotiations with the workers' compensation carrier, which resulted in a lump sum settlement in the amount of $437,500, along with the workers' compensation carrier fully funding a Workers' Compensation Medicare Set-aside Trust to cover the injured worker's future medical care for his work-related injury over his lifetime.

October 2014: Settles Workers' Compensation Claim for $175,000

Claimant sustained a work-related injury to his lower back on August 23, 2013. After missing several weeks of work due to his injuries, he attempted to return to work in a modified part time capacity in November 2013. Although suffering a loss of earnings, the Workers' Compensation carrier unilaterally ceased paying benefits.

After retaining the services of the Law Offices of Richard A. Jaffe, LLC, Richard was able to secure all the back due and also reinstatement of his workers comp benefits effective March 17, 2014 at the maximum disability rate of $918 per week.

After Richard assisted his client in securing appropriate medical care with a board certified pain management specialist, attorney Jaffe's client eventually recovered sufficiently to be able to consider resuming his prior vocation, so long as he was not required to perform the very heavy lifting required of his previous job. As a result, Richard was able to negotiate a settlement of his Workers' Compensation claim for $175,000.

October 2014: Wins Appeal before the Workers' Compensation Appeal Board

Claimant sustained a work-related injury in Florida in June 2010 while working for a company in Pennsylvania. The employer and its Workers' Compensation carrier failed to recognize the injured Workers' Compensation claim, and Richard A. Jaffe was successful in litigating his claim petition such that the injured worker's significant injuries were recognized as compensable.

After the Workers' Compensation judge adopted a stipulation of fact resulting in Richard's client securing significant back due Workers' Compensation benefits, the Workers' Compensation carrier was entitled to a "credit" for wages paid by the employer when it failed to report the injury to its carrier. Further, the attorney Richard A. Jaffe's client's extensive medical bills were to be paid by the Workers' Compensation carrier.

When the Workers' Compensation carrier unilaterally reduced the injured worker's entitlement to Workers' Compensation benefits and further, failed to pay the claimant's outstanding medical bills in a timely manner, Richard filed a petition for penalties. The Workers' Compensation judge granted the petition for penalties with respect to the failure to pay the injured worker's medical bills in a timely manner. But the judge failed to award a penalty with respect to the unilateral cessation of the injured workers benefits.

Both parties filed an appeal to the WCAB. By opinion and order circulated in October 2014, the WCAB affirmed the award of a 50 percent penalty on untimely payments of claimant's outstanding medical bills which will result in a payment to the injured worker in excess of $45,000 as a penalty.

In addition, the WCAB agreed with Richard that the Workers' Compensation judge erred by failing to award an additional penalty for the unilateral reduction of the injured Workers' Compensation benefits and has remanded this matter back to the Judge with instructions to award additional penalties.

August 2014: Settles Workers' Compensation Claim for $231,469.41

Claimant sustained a work-related injury on November 12, 1998 to his left upper extremity. Richard A. Jaffe settled his client's entitlement to future wage loss benefits for $62,500 in 2001 which enabled the Claimant to continue to receive reasonable and necessary medical treatment for his injured left arm and hand. As a result, the injured worker was able to receive excellent medical care in the nature of pain management for well over a decade thereafter.

After undergoing an IME in 2014, Richard was able to negotiate a settlement of his client's entitlement to future reasonable and necessary medical treatment for $231,469.41. By placing said monies into a "Special Needs Trust" the injured worker will continue to be eligible to receive his SSI Benefits and pay for his work-related medical treatment for the remainder of his life; and any monies left over will go to his estate.

August 2014: Settles Workers' Compensation Claim for $95,000

Claimant sustained a work-related injury to her left wrist and hand on or about December 27, 1996. Richard was able to expand the description of injury to include a major depressive disorder and chronic pain syndrome enabling his client to secure necessary psychiatric care and pain management treatment as a result of a judge's decision in 2008. The injured worker underwent an Impairment rating evaluation in 2010, and unfortunately, the Workers' Compensation judge granted the petition to modify claimant's benefits in 2011 resulting in a change in claimant's status from Temporarily Totally Disabled to Partially Disabled.

As a result of protracted negotiations, Richard was able to settle his client's remaining entitlement to Partial Disability Benefits for $95,000, which allowed her to also continue to receive ongoing reasonable and necessary medical treatment for her left wrist and chronic pain syndrome. Said settlement shall also result in an increase in the Social Security disability benefits that Richard secured for her in 2004.

May 2014:  Settles Workers' Compensation Claim for 73-year-old Woman for $95,000

Claimant sustained a work-related injury on August 23, 2000, to her lower back while working for the Philadelphia Housing Authority. After retaining Richard's services in August 2003, attorney Jaffe was able to defeat two attempts by the Workers' Compensation carrier to terminate the injured workers benefits, enabling her to continue to receive her weekly disability rate of $567.68.

Eventually, she received Social Security "Old Age Benefits," which reduced her entitlement to Workers' Compensation benefits and in the midst of litigation once again attempting to modify her benefits based upon an impairment rating evaluation we were able to settle her Workers' Compensation claim for $95,000 along with ongoing medical treatment until the Workers' Compensation carrier fully funds a Workers' Compensation Medicare Set-aside as required by CMS. This will add additional value to the injured workers settlement.

May 2014:  WCAB Grants Motion to Quash filed by Richard A. Jaffe

After Richard A. Jaffe was successful in securing a significant award of penalties for his client as a result of the School District of Philadelphia's refusal to "pre-authorize" treatment for her work-related shoulder injury, the attorneys for the School District of Philadelphia filed an untimely appeal to the Workers' Compensation Appeal Board. In addition, the defendants filed an appeal nunc pro tunc, arguing there was a breakdown in the system due to the advent of the new WCAIS computer system utilized by both the Bureau of Workers' Compensation and the WCAB. Richard filed a Motion to Quash the Defendant's Appeal and Appeal nunc pro tunc.

After hearing oral argument from both parties and reviewing their briefs, the WCAB issued an opinion and order on May 8, 2014 granting the motion to quash, dismissing both appeals filed by the School District of Philadelphia, which resulted in affirming the significant Award of Penalties which Richard was able to secure for his client. In addition, the claimant was finally able to secure the surgery she so desperately needed for her work-related shoulder injury.

April 2014: Settles Workers' Compensation Claim for $125,000

Non-English speaking factory worker sustained a work-related injury in the nature of bilateral carpal tunnel syndrome on or about November 3, 2011, which was not recognized by her employer. As a result of Richard's efforts, her claim petition was ultimately granted entitling her to receive $429 per week in Workers' Compensation benefits as well as ongoing medical care and surgery to address the bilateral carpal tunnel syndrome. As her condition improved, we were able to settle her Workers' Compensation claim in April 2014 for $125,000.
